The electricity distribution market was also affected by the privatisation efforts in Turkey and eventually TEDAŞ was replaced by 21 electricity distribution companies (EDAŞ). The electricity distribution company is the company that provides the monopoly electricity distribution service to the end-user customer as stipulated by the legislation and is also the only authorised company in its region with the operating right transfer agreement. Since these companies are private law legal entities, they are required to sign a transfer of operating rights agreement with the administration in order to use the existing infrastructure and fulfil the electricity distribution activity, which is a public service. The transfer of operating rights agreement is the most important document regulating how distri- bution companies can use electricity distribution assets. The ownership of electricity distribution assets belongs to TEDAŞ and these assets are made available to distribution companies under a transfer of operating rights agreement and on condition that only distribution activities are carried out. Sometimes distribution companies exceed their contractual authorisations and use these electricity distribution assets for other purposes. The exclusion of TEDAŞ from the scope of the sharing of the income obtained from the use of these assets, which are the property of TEDAŞ, prejudices the right to property. The issue will be analysed in the context of the relevant legislation, audit reports, judicial decisions and especially the property right.
