THE EFFECT OF DETENTION AND CONVICTION OF DEBTOR ON ENFORCEMENT PROCEEDINGS

The Enforcement and Bankruptcy Law did not see it correctly to follow up against the debtor in some cases on social grounds and found it appropriate not to perform follow-up procedures during the time these situations ad appeared. In these cases, which are organized under the title of “Restdays and Postponement” between 51 and 56, execution follow-up procedures cannot be made against the debtor. The debtor’s imprisonment and imprisonment were also arranged as one of their state in IIK m.54. In our study, first of all, restday and postponement states will be generally explained and then the effects and consequences of detention and sentence on the enforcement follow-up process will be discussed.
