The use of AI in the activities of the administration, its regulation and administrative supervision are becoming increasingly important due to the increasing impact of AI on administrative law issues. While artificial intelligence technologies become visible on the administration in a functional aspect, on the other hand, they lead to the reorganisation of the administration in an organic aspect. The reflections of artificial intelligence on the institutional structure can be explained by administrative structures with duties and competencies specific to artificial intelligence in the administrative organization. It is discussed whether the administrative units with duties and powers in the field of artificial intelligence in the Turkish administrative organisation are sufficient for the regulation and administrative supervision of artificial intelligence. In this study, based on the institutional transformation created by the developments in the field of artificial intelligence in the administra-tive organisation in our country; the grounds for the need for a new institutional model in the field of artificial intelligence will be revealed. As a method, legislative regulations, international documents, strategies and action plans will be referred to. Within the scope of the study, examples of different countries regarding the reflections of developments in the field of artificial intelligence on administrative organizations will be given and the regulations explaining the strategy of our country will be evaluated. Then, the potential of the administrative bodies in the field of artificial intelligence within the executive to meet the need for national institutions for the enforcement and supervision of artificial intelligence in the private sector and public activities in accordance with the law will be discussed. Finally, the proposal of a regulatory and supervisory institution model, which will carry out regulation and administrative supervision activities in the field of artificial intelligence and which has the characteristics of a national institution, will be emphasized.

Artificial intelligence (AI) is bringing more changes across various legal fields, with particularly significant implications for administrative law. This study aims to explore the effects of AI advancements on administrative organizations, highlighting the necessity for a national competent authority responsible for the administrative oversight of AI. Furthermore, this research proposes a structural model for the establishment of such an authority, thereby contributing to the literature surrounding AI regulation and governance.
The current literature reveals a notable gap in studies that directly examine the implications of AI on administrative organizations. This situation underscores the significance of the this study in contributing to the academic field. Most existing analyses have primarily addressed the relationship between artificial intelligence and administrative law from the perspective of administrative transactions. However, it is essential to consider not only the functional aspects of administration but also its organic dimensions in relation to AI.
The integration of AI into administrative processes necessitates a reevaluation of traditional administrative structures and practices. This study seeks to deepen the understanding of AI’s impact on administrative organizations by giving examples both theoretical and practical dimensions. By proposing a model for effective administrative supervision, this research aims to fill the existing void in the literature and provide a foundation for future inquiries into this critical area.
This study employs a mixed-method approach, combining qualitative and quantitative analyses of legal texts and official publications. The methodology includes a comprehensive review of relevant literature, and comparative analyses to elucidate the multifaceted effects of AI on administrative organizations.
The findings of the study indicate that AI developments have significant and varied impacts on administrative organizations. These impacts manifest in several ways, including the establishment of new administrative units, such as dedicated ministries for AI in certain countries. For instance, nations like UAE and İspanya or international organizations like UN have recognized the need for specialized governmental bodies to address the complexities introduced by AI technologies.
Moreover, supranational organizations, including the European Union, have actively encouraged member states to create national competent authorities in response to the rapid advancements in AI. These authorities are envisioned as regulatory bodies equipped to oversee the deployment and governance of AI technologies within their respective jurisdictions. The study also critically evaluates the Turkish National AI Strategy document, which serves as a roadmap for understanding the implications of AI developments in Turkey. This document provides vision into the anticipated effects of AI on administrative organizations. However in this documecnt is been lack of future plan in regarding authority which has a competency for administrative supervision.
The analysis culminates in the conclusion that a national authority is essential for the administrative supervision of AI in Turkey. The necessity for such an authority can be explain by several factors: the specialized required in the AI and administrative supervision , the increasing prevalence of AI applications in both public and private sectors, and the imperative for transparency and predictability in administrative activities.
The establishment of a national authority would serve multiple purposes, including the regulation of AI technologies, the promotion of ethical standards, and the facilitation of public trust in AI systems. This authority should be designed as a regulatory and supervisory institution, equipped to set standarts and supervision the human rights violations posed by AI. It is suggested that in this study the authority operates with foresight, anticipating future developments in AI and adapting the legal regulations accordingly.
In light of these findings, it is recommended that policymakers in Turkey take proactive steps to address the regulatory gap in the AI field. This includes revising existing administrative structures to accommodate the challenges posed by AI technologies and ensuring that a national authority is empowered to fulfill its mandate effectively.
