People have to work to meet their essential needs. It is a requirement of the right to life that employees work without being exposed to physiological risks. In case of deterioration of health status due to working conditi- ons, employees are faced with occupational diseases. In order to be able to talk about the existence of an occupational disease, it is necessary to be insured, to suffer physical and mental damage to the insured, and this situation must be caused by working for a long time or by the work carried out. In the presence of these conditions, SSGSSK No. 5510. In order to benefit from occupational disease insurance under Article 14, it is necessary to apply to the Social Security Institution and document this situation with a health board report. Since our study is limited to the concept of occupational disease, the conditions for benefiting from occupational disease insurance and the rights provided have not been examined.
In the event of prevention of occupational disease, the right to life of the employees will be protected, the employer will not be faced with the consequences of the occupational disease, and the compensation obligation will be eliminated, and at the same time, the employer will not have lost its workforce. The state, on the other hand, will be freed from the obligation of insurance assistance due to the prevention of social risk, and the country’s economy will be prevented from being adversely affected. In international documents for the prevention of occu- pational diseases, many regulations have been made in comparative law, the importance of data collection has been emphasized, and the importance of raising awareness of these diseases has been emphasized with the Occupational Diseases Lists created. In our law, the State carries out the practices for the prevention of occupational diseases with the institutional structure it has created.
